1. Scope
These Terms of Service ("Terms") govern your use of TootFlow (tootflow.com), a web-based service for planning, drafting, and automatically publishing Mastodon social media campaigns ("Service"), operated by the individual identified in the Impressum.
By registering an account or purchasing a campaign activation you agree to these Terms. If you do not agree, do not use the Service.
2. Account registration
Access to the Service requires signing in via Mastodon OAuth. No email address is required. You are responsible for keeping your Mastodon access authorisation secure. You may not share your account with others.
You must be at least 16 years old to use the Service.
3. Campaigns and pricing
Free tier
Creating campaigns, writing and editing posts manually, and automated publishing via your Mastodon account are available at no cost. No payment is required to schedule or publish posts.
Premium activation
Each campaign may optionally be activated for a one-time fee of 5 EUR (including applicable VAT). This is a single charge per campaign — there are no subscriptions, recurring fees, or hidden costs.
Payment is processed by LemonSqueezy, acting as Merchant of Record. TootFlow never receives or stores your payment card details.
A premium activation entitles you to:
- AI-generated post schedules (up to the limit shown in the campaign)
- Full per-post engagement metrics (favourites, reblogs, replies, poll votes)
- Export Studio — repurpose your campaign as a Newsletter digest, LinkedIn article, or Reddit post, subject to the per-campaign export generation limit
Pricing may change for future campaigns. Already-activated campaigns are not affected by price changes.
4. Right of withdrawal (Widerrufsrecht)
Withdrawal policy
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day the contract is concluded (i.e. the day your payment is confirmed).
To exercise the right of withdrawal, you must notify us by an unambiguous statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract:
To meet the withdrawal deadline it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract we will reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will use the same means of payment as you used for the initial transaction unless expressly agreed otherwise.
Loss of right of withdrawal for digital services
Please note: In accordance with §356 Abs. 5 BGB and Art. 16(m) of Directive 2011/83/EU, the right of withdrawal expires before the end of the 14-day period if:
- the performance of the digital service has begun, and
- you have explicitly consented to the immediate start of performance, and
- you have acknowledged that you thereby lose your right of withdrawal.
When activating a campaign, you will be asked to confirm the immediate start of the service at checkout. If you give that confirmation, your right of withdrawal is forfeited once AI generation or post publishing has commenced.
If you have not yet used any AI generation, Export Studio, or premium metrics features, you retain the full 14-day right of withdrawal. Contact hello@tootflow.com to request a refund.
5. Your obligations
You agree not to use the Service to:
- Post content that is illegal, defamatory, harassing, or violates third-party rights
- Violate the terms of service of your Mastodon instance
- Attempt to circumvent rate limits, access controls, or security measures
- Use the Service for bulk spamming or automated abuse
You are solely responsible for all content you publish through TootFlow, whether created manually or with AI assistance. We act as a technical intermediary and do not review post content before it is published to your Mastodon account.
6. Service availability
We aim to keep the Service available but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages (Mastodon instances, OpenAI, LemonSqueezy), or unforeseen technical issues may cause temporary unavailability.
If a post fails to publish due to a service-side error, it will be retried on the next scheduler run. We are not liable for missed publication windows caused by third-party downtime or configuration errors on your Mastodon instance.
7. Limitation of liability
To the maximum extent permitted by applicable law, TootFlow is provided "as is" without warranty of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including lost revenue, reputational damage, or missed publishing opportunities.
Our total liability for direct damages shall not exceed the amount you paid for the affected campaign.
Nothing in these Terms limits liability for damages caused by wilful misconduct or gross negligence, or for claims arising under mandatory statutory consumer protection law.
8. Account deletion and data
You may delete your account at any time via Account Settings. Deletion is immediate and permanent — all campaigns, posts, and associated data are erased. Paid campaigns are not refunded upon voluntary account deletion after the withdrawal period has expired.
9. Changes to these Terms
We reserve the right to modify these Terms. Material changes will be announced by updating the "Last updated" date at the top of this page and, where feasible, by a notice in the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Service and may delete your account.
10. Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. If you are a consumer resident in an EU member state, you additionally benefit from any mandatory consumer protection provisions of your country of residence.
The place of jurisdiction for all disputes arising from or in connection with these Terms is 12345 Berlin, Germany, to the extent permitted by law.
